IND said no? How to object to or appeal a decision

A refusal is not always the end. Many decisions can be changed – if you act quickly and give strong reasons.

Urgent – 24 hoursDoes your decision say you may not wait in the Netherlands? Then you must leave – unless you ask the court for a provisional ruling (voorlopige voorziening) within 24 hours of receiving the decision. Contact us immediately.

Objection (bezwaar) in 5 steps

  1. 1

    Read the decision carefully

The letter states the deadline for your objection and whether you may wait for the outcome in the Netherlands. Note both dates straight away – a late objection is usually not accepted.

  2. 2

    Write your objection letter

Include your name and address, the date, which decision you object to, why you disagree, and your signature. Add a copy of the IND decision and any documents that support your case.

  3. 3

    Send it on time

By post to the address in the decision, by secure email with your case number in the subject line (max. 10 MB per document, 20 MB per email), or upload it with DigiD.

  4. 4

Complete your file within 2 weeks

The IND confirms receipt and tells you the decision period. If something is missing, you have 2 weeks from the IND letter to send it.

  5. 5

    The outcome

The IND rules your objection well-founded – you get what you asked for – or unfounded. An unfounded objection is a rejection, and you can then appeal to the court.

Which decisions?

Short-stay visas, MVV and residence permits, sponsor recognition, Dutch nationality, suspension of departure, entry bans and return decisions.

Approved, but not as you asked?

You can also object to a positive decision – for example the start date of your permit. Deadline: 4 weeks after collecting your residence document.

Can I stay during the objection?

Your decision says so. If yes, you can collect a residence endorsement sticker at an IND desk as proof – see IND appointments.

Who can object for you?

You yourself, a legal representative, someone you authorise in a signed letter, or – for residence permits – your recognised sponsor.

How long does it take?

Usually 6 to 19 weeks, depending on the application – see our overview of IND decision periods.

Appeal to the court (beroep)

After an unfounded objection you can go to court. The court procedure and deadlines are explained on the Rechtspraak website; for legal aid, the Juridisch Loket can help.
